# Verordnung des EDI über die Verzeichnisse der Betäubungsmittel, psychotropen Stoffe, Vorläuferstoffe und Hilfschemikalien

(Betäubungsmittelverzeichnisverordnung, BetmVV-EDI)

vom 30. Mai 2011 (Stand am 13. März 2026)

Das Eidgenössische Departement des Innern (EDI),

gestützt auf Artikel 3 Absatz 1 der Verordnung vom 25. Mai 2011[^1]<br />über die Betäubungsmittelkontrolle (BetmKV),

verordnet:

##### **Art. 1** Kontrollierte Substanzen {#art_1 omnilex-key=ch-fedlex--812.121.11--1}
1. Kontrollierte Substanzen sind Betäubungsmittel, psychotrope Stoffe, Rohmaterialien und Erzeugnisse mit vermuteter betäubungsmittelähnlicher Wirkung, Vorläuferstoffe und Hilfschemikalien nach Artikel 2*a* und Artikel 7 des Betäubungsmittelgesetzes vom 3. Oktober 1951[^2](BetmG).
2. Betäubungsmittel, psychotrope Stoffe, Rohmaterialien und Erzeugnisse mit vermuteter betäubungsmittelähnlicher Wirkung nach den Artikeln 2*a* und 7 BetmG sind:[^3]
a. die in den Verzeichnissen in den Anhängen 1–6 aufgeführten Stoffe;
b.[^4] die Salze, Ester, Ether, Carbamate und Stereoisomere der Stoffe nach Buchstabe a;
c.[^5] die Salze, Ester, Ether und Carbamate der Stereoisomere nach Buchstabe b;
d. Präparate, die Stoffe nach den Buchstaben a–c enthalten.
3. Vorläuferstoffe und Hilfschemikalien nach Artikel 2*a* BetmG sind:
a. die in den Verzeichnissen in den Anhängen 7 und 8 aufgeführten Stoffe;
b. die Salze und Stereoisomere der Vorläuferstoffe im Anhang 7;
c. die Salze der Stereoisomere nach Buchstabe b;
d. Mischungen, die Substanzen nach den Buchstaben a–c enthalten.
4. Wird eine in einem Anhang aufgeführte Substanz ganz oder teilweise von Kontrollmassnahmen ausgenommen (Art. 3 Abs. 2 BetmG), so gilt die Ausnahme auch für ihre Verbindungen. Die Ausnahme gilt auch für Präparate, die diese Substanz enthalten, sofern sie keine weiteren kontrollierten Substanzen enthalten.
5. Die kontrollierten Substanzen werden mit den in den internationalen Übereinkommen verwendeten Bezeichnungen aufgeführt.

##### **Art. 2** Verzeichnisse der kontrollierten Substanzen {#art_2 omnilex-key=ch-fedlex--812.121.11--2}
1. Die Verzeichnisse a–d mit den kontrollierten Substanzen nach Artikel 3 Absatz 2 Buchstaben a–d BetmKV finden sich in den Anhängen 1–5.
2. Das Verzeichnis e mit den Rohmaterialien und Erzeugnissen mit vermuteter betäubungsmittelähnlicher Wirkung nach Artikel 3 Absatz 2 Buchstabe e BetmKV findet sich in Anhang 6.
3. Das Verzeichnis f mit den Vorläuferstoffen nach Artikel 3 Absatz 2 Buchstabe f BetmKV findet sich in Anhang 7.
4. Das Verzeichnis g mit den Hilfschemikalien nach Artikel 3 Absatz 2 Buchstabe g BetmKV findet sich in Anhang 8.

##### **Art. 3** Mohnstroh {#art_3 omnilex-key=ch-fedlex--812.121.11--3}
Mohnstroh (Mohnkapseln, Mohnköpfe, Mohnstängel), das nicht zur Herstellung von Betäubungsmitteln dient, darf nur mit Bewilligung des Instituts ein- oder ausgeführt werden. Dessen Handel im Inland bedarf keiner Bewilligung.

##### **Art. 4** {#art_4 omnilex-key=ch-fedlex--812.121.11--4}

##### **Art. 5** Vorläuferstoffe {#art_5 omnilex-key=ch-fedlex--812.121.11--5}
1. Vorläuferstoffe, welche der Kontrolle unterliegen, sind im Verzeichnis f in Anhang 7 aufgeführt.
2. Wer in einem Kalenderjahr weniger als 10 Gramm eines Vorläuferstoffes, ausgenommen Lysergsäure, verwendet, braucht diesen Stoff nicht kontrollieren zu lassen. Die Kontrolle der Jahresmenge obliegt der Bewilligungsinhaberin oder dem Bewilligungsinhaber.
3. Werden für Vorläuferstoffe Synonyme oder Fantasienamen verwendet, so muss zusätzlich die Registernummer für Chemikalien nach «Chemical Abstract Services» (CAS-Nummer) angegeben werden.

##### **Art. 6** Hilfschemikalien {#art_6 omnilex-key=ch-fedlex--812.121.11--6}
1. Die Hilfschemikalien im Verzeichnis g im Anhang 8 unterstehen der Kontrolle je nach Zielland und Gesamtausfuhrmenge.
2. Bei jedem Stoff werden die Gesamtausfuhrmenge pro Kalenderjahr und Zielland, sowie die Zielländer aufgeführt, für welche die Ausfuhr vom Institut bewilligt werden muss. Die Kontrolle der Jahresmenge obliegt der oder dem Ausführenden.

##### **Art. 7** Nachführen der Verzeichnisse {#art_7 omnilex-key=ch-fedlex--812.121.11--7}
Das Institut überprüft, gestützt auf die internationale Entwicklung und auf vermutete neue Gefährdungen, regelmässig die einzelnen Verzeichnisse und stellt dem EDI Antrag auf Anpassungen.

##### **Art. 8** Inkrafttreten {#art_8 omnilex-key=ch-fedlex--812.121.11--8}
Diese Verordnung tritt am 1. Juli 2011 in Kraft.
