# VERORDNUNG (EG) Nr. 1300/2004 DER KOMMISSION

vom 15. Juli 2004

zur Festsetzung der Beihilfe für nicht entkörnte Baumwolle für das Wirtschaftsjahr 2003/04

## Preamble

DIE KOMMISSION DER EUROPÄISCHEN GEMEINSCHAFTEN —

gestützt auf den Vertrag zur Gründung der Europäischen Gemeinschaft,

gestützt auf die Akte über den Beitritt Griechenlands, insbesondere das Protokoll Nr. 4 über Baumwolle [^1] ,

gestützt auf die Verordnung (EG) Nr. 1051/2001 des Rates vom 22. Mai 2001 über die Erzeugerbeihilfe für Baumwolle [^2] , insbesondere auf Artikel 2 Absatz 1,

in Erwägung nachstehender Gründe:

**(1)** Gemäß Artikel 2 Absatz 1 der Verordnung (EG) Nr. 1051/2001 wird die Höhe der Erzeugerbeihilfe für nicht entkörnte Baumwolle festgesetzt auf der Grundlage der Differenz zwischen dem Zielpreis für nicht entkörnte Baumwolle, der gemäß Artikel 3 Absatz 1 und Artikel 7 derselben Verordnung ermittelt wird, und dem Weltmarktpreis, der gemäß Artikel 4 derselben Verordnung bestimmt wird.

**(2)** Gemäß Artikel 4 Absatz 1 der Verordnung (EG) Nr. 1591/2001 der Kommission vom 2. August 2001 zur Durchführung der Beihilferegelung für Baumwolle [^3] wird die Beihilfe, die für nicht entkörnte Baumwolle in den Zeiträumen zu gewähren ist, für die ein Weltmarktpreis für das betreffende Erzeugnis bestimmt wurde, spätestens am 30. Juni des betreffenden Wirtschaftsjahres festgesetzt.

**(3)** Gemäß Artikel 7 der Verordnung (EG) Nr. 1051/2001 ist mit der Verordnung (EG) Nr. 1123/2004 der Kommission [^4] die tatsächliche Erzeugung nicht entkörnter Baumwolle sowie die sich daraus ergebende Verringerung des Zielpreises für das Wirtschaftsjahr 2003/04 festgesetzt worden.

**(4)** Gemäß Artikel 4 Absatz 1 der Verordnung (EG) Nr. 1051/2001 ist der Weltmarktpreis für nicht entkörnte Baumwolle im Wirtschaftsjahr 2003/04 regelmäßig bestimmt worden.

**(5)** Daher sind die im Wirtschaftsjahr 2003/04 geltenden Beihilfen für jeden Zeitraum festzusetzen, für den ein Weltmarktpreis für nicht entkörnte Baumwolle bestimmt wurde —

HAT FOLGENDE VERORDNUNG ERLASSEN:

## **Artikel 1**

Für den Zeitraum vom 1. Juli 2003 bis 31. März 2004 sind die Beihilfen für nicht entkörnte Baumwolle, die den Weltmarktpreisen gemäß den Verordnungen im Anhang entsprechen, in demselben Anhang festgesetzt und ab dem Inkrafttreten der genannten Verordnungen anwendbar.

## **Artikel 2**

Diese Verordnung tritt am siebten Tag nach ihrer Veröffentlichung im *Amtsblatt der Europäischen Union* in Kraft.

## Final provisions
