Land readjustment is an ownership restriction, not expropriation

Omnilex-Zusammenfassung

The decision explains that a planning zone may only be imposed when legislative or planning changes are already in a concrete, sufficiently advanced phase. It further holds that land readjustment under the cantonal implementing rules is a public-law restriction on ownership and not a formal expropriation, because the owner's property is to be preserved in value, use, and size through real substitution. However, where the readjustment procedure cannot satisfy legitimate substitute-entitlement claims, the owner may rely on expropriation safeguards, especially if buildings or spring rights are affected and real substitution is typically impossible.

Omnilex-Regeste

Art. 113 Abs. 3 and 114 EG zum ZGB; Baulandumlegung and planning zone prerequisites; land readjustment as a public-law ownership restriction, not formal expropriation. A planning zone presupposes that the envisaged legislative or planning change has already entered a sufficiently concrete phase. Land readjustment is characterized by the principle of real substitution; it must preserve the affected parcel in value, use and size and is therefore only materially akin to expropriation. Owing to this proximity, the owner may nonetheless invoke the guarantees of expropriation proceedings where the readjustment procedure cannot secure equivalent replacement, notably where structures or easement-like rights are taken and real substitution is generally impossible.

Gesamter Gesetzestext

Juli 1985 i.S. R. AG). RRB 25.2.1986 1148 Baulandum legung. BGE 95 I 372), wofür eine gesetzliche Grundlage bestehen muss. RRB 4.12.1984 1 Heute: vgl. Kernrechtsfrage

Whether the prerequisites for a planning zone were met only if legislative or planning changes had reached a specific concrete stage.

Extrahierter Entscheid

A planning zone requires that changes in legislation or planning are already in a sufficiently concrete phase.

Extrahierte Begründung

The governmental decisions cited hold that a planning zone is not justified by abstract future intentions; the threatened change must be specific and advanced enough.

Kernrechtsfrage

Whether land readjustment is a formal expropriation or merely an ownership restriction.

Extrahierter Entscheid

Land readjustment is a public-law restriction on ownership based on real substitution; it is not formal expropriation.

Extrahierte Begründung

The measure has a statutory basis and is characterized by preservation of the property's value, use, and size; it rests on the principle of real replacement and is only closely related to expropriation.

Kernrechtsfrage

Whether an owner may invoke expropriation safeguards in the readjustment procedure.

Extrahierter Entscheid

Yes, expropriation safeguards may be invoked when the readjustment procedure cannot satisfy legitimate substitute-entitlement claims, for example where a building or spring right is affected and real substitution is usually impossible.

Extrahierte Begründung

Because of the measure's proximity to expropriation, constitutional and procedural guarantees of expropriation apply subsidiarily where equivalent compensation cannot be provided.
