A judicial allocation of children to one parent in divorce proceedings does not deprive cantonal guardianship authorities of their competence to take protective measures under cantonal law when parental duties are insufficient (consid. 2). Such intervention does not, as a rule, violate personal liberty or freedom of settlement, since these guarantees do not exclude measures concerning the care and supervision of minors. A denial of the right to be heard is not made out where the authority’s knowledge of the party’s whereabouts is unproven and subsequent submissions may still be received and assessed (consid. 3).
