Art. 126 Ziff. 1 OR; redemption of a pledge by a third party and transfer of creditor’s rights in bankruptcy distribution: payment of the secured creditor by the third-party pledgor effects statutory subrogation without a separate assignment deed. A claim collocated as secured by a pledge is not thereby confined exclusively to satisfaction from the pledged object; if the pledge is redeemed and no security remains, the claim becomes uncovered in the bankruptcy and may participate in the general dividend alongside unsecured creditors. The debtor’s estate is not enriched by an erroneous collateral designation, and the subrogated payer may contest the distribution to the extent of the transferred claim (consid. 1-2).
