Where federal law leaves notification of the cantonal judgment to cantonal procedure, the judgment is deemed communicated when, under cantonal law, the parties or their representatives have been duly summoned to and have attended the publication hearing. The subjective date on which counsel actually informs the party is irrelevant to the peremptory federal time limit. The appeal is therefore inadmissible if filed after expiry of the statutory period (consid. 1–3). Costs may be waived for an indigent party who cannot bear litigation expenses and has already benefited from legal aid (consid. 4).
