BGE 40 I 1
BGE 40 I 1Amtliche Sammlung des Bundesgerichts (BGE) / I27.02.1914
The provided text is a statutory provision, not a judicial decision. It states that in disputes decided by conciliation offices, district court presidents, and court commissions, including nullity complaints, and in all summary disputes, debt enforcement and bankruptcy matters, professional party representation is permitted only for persons authorized by the cantonal court to practice as legal agents, where such representation is legally allowed.
Art. 77; professional party representation in certain cantonal proceedings is restricted to persons holding the cantonal court’s authorization to practice as legal agents. The provision applies to disputes decided by conciliation offices, district court presidents and court commissions, including nullity complaints, as well as to all summary disputes and debt-enforcement and bankruptcy matters, insofar as professional representation is legally admissible. It establishes an exclusive authorization requirement for professional representatives in these proceedings.
