Art. 2, 6 and 27 of the Federal Act on the Supervision of Forest Police in the High Mountains; federal jurisdiction over cantonal execution measures and penalties: the delimitation of mountain areas subject to federal supervision is entrusted by the statute to the Federal Council in agreement with the cantonal governments, or to the Federal Assembly in case of disagreement; the Federal Court is not competent to review the material correctness of such delimitation. Likewise, the adjudication of offenses listed in Art. 27 is left to the cantons; therefore the Federal Court cannot control the concrete application of the penalty provisions in an individual case. A complaint attacking such matters is accordingly unfounded or inadmissible, depending on the object challenged (consid. 2-3).
Gesetzesbestimmung sei. Hinsichtlich des eventuellen Begehrens machte der Regierungsrath darauf aufmerksam, daß die Beur theilung solcher Straffälle nach Art. 27 leg. cit. den kantonalen Gerichten zukomme, woraus folge, daß das Bundesgericht über Vollzug und Anwendung der Strafbestimmungen in concreto formell keine Jurisdiction habe. Das Bundesgericht zieht in Erwägung:
