Selon la jurisprudence, l'inexécution intentionnelle de l'obligation d'entretien des époux l'un envers l'autre est en principe punissable, même lorsque les prestations n'ont pas été fixées au préalable par le juge civil; il n'en va autrement que si les conjoints cessent de faire ménage commun parce qu'ils sont en instance de divorce (RO 70 IV 167). L'obligation d'entretien doit alors avoir été constatée soit par un prononcé judiciaire, soit par un accord privé (RO 74 IV 52, 159; 76 IV 118 consid. 4).

Ces principes appellent une précision. Sans doute une convention des parties ou une décision judiciaire fondée sur l'art. 145 CC est-elle nécessaire pour déterminer le montant des subsides dus, c'est-à-dire l'étendue de l'obligation. En revanche, l'existence de la dette résulte de l'art. 160 al. 2 CC, qui astreint le mari à pourvoir à l'entretien de sa femme pendant toute la durée du mariage. L'existence de l'obligation ne dépend pas de la détermination de son étendue. Aussi n'est-il pas exclu que l'inexécution de l'obligation puisse être constatée par le juge pénal, sans que le montant des prestations dues ait été fixé au préalable. Tel sera le cas lorsque le débiteur n'a rien payé, ou lorsqu'il ne s'acquitte pas d'un montant que lui-même estime dû. On doit cependant réserver l'éventualité où le mari contesterait l'obligation même de subvenir à l'entretien de sa femme, en alléguant par exemple qu'elle a quitté la demeure conjugale sans motifs suffisants (cf. arrêt de la Chambre de droit public du 16 juillet 1927 dans la cause Inaebnit). Il n'est pas nécessaire de décider aujourd'hui si le juge pénal serait aussi compétent pour examiner cette question préjudicielle de droit civil.
