Supervisory complaint over delay declared inadmissible

Omnilex-Zusammenfassung

The complainant filed a supervisory complaint alleging undue delay in proceedings before the Federal Administrative Court. The Federal Supreme Court held that such grievances against judicial decisions cannot be pursued through supervisory review, because denial-of-justice arguments must be raised by public law appeal. It therefore did not enter into the complaint. The Court also noted that the underlying Federal Administrative Court judgment of 12 August 2009 had already annulled the cantonal invalidity-insurance decision and remitted the case, making part of the complaint moot. No fees or compensation were awarded.

Omnilex-Regeste

A supervisory complaint alleging denial of justice or undue delay against a judicial decision is inadmissible where the applicable procedural law provides an ordinary public-law appeal in which that grievance may be raised. Judicial decisions are excluded from supervisory oversight. If the underlying judgment has already resolved the matter or remitted it, related requests may also become moot. In such a non-entry decision, no court costs or party compensation are typically awarded absent special grounds.

Décision du 10 septembre 2009
Commission administrative

Composition
M. le Juge Lorenz Meyer, Président,
Mme la Juge Leuzinger, Vice-présidente,
M. le Juge Kolly, Juge fédéral,
M. le Secrétaire général Tschümperlin.

Dénonciateur
X.________, représenté par Me Pierre Gabus, avocat, dénonciateur,

contre

Kernrechtsfrage

Whether a supervisory complaint for denial of justice or undue delay against the Federal Administrative Court was admissible.

Extrahierter Entscheid

It was inadmissible because such a complaint cannot be used to supervise the judiciary; the grievance must be raised in an appeal to the Federal Supreme Court.

Extrahierte Begründung

Under the applicable rules, decisions of the Federal Administrative Court in social insurance matters may be challenged by public law appeal, and denial of justice or undue delay can be raised at any time in that appeal. Judicial decisions are excluded from supervisory review.

Kernrechtsfrage

Whether the complaint was moot in part because the Federal Administrative Court had already allowed the underlying appeal and remitted the matter.

Extrahierter Entscheid

Yes, the earlier judgment of 12 August 2009 partly rendered the requests without object.

Extrahierte Begründung

The Federal Administrative Court annulled the cantonal AI decision and remitted the case, so the complainant's delay-related requests were in part moot.
