The Municipality of Giubiasco filed a public law appeal against Ticino legislation and its implementing regulation on police cooperation, seeking partial annulment. After the Federal Supreme Court had already refused suspensive effect, the municipality withdrew the appeal following a settlement with the Cantonal Government. Acting as single judge, the President struck the case from the roll. The Court waived court costs and denied party compensation, noting that municipalities are generally not charged costs and that the municipality acted in the exercise of official duties.

No party compensation is owed where the appellant acted in its official capacity and no representation by counsel is involved, absent special circumstances (Art. 68 cpv. 3 LTF).

Legge sulla collaborazione fra la Polizia cantonale e le Polizie comunali e relativo Regolamento,
ricorso contro la legge del 16 marzo 2011 sulla collaborazione fra la Polizia cantonale e le Polizie comunali decretata dal Gran Consiglio e il relativo regolamento adottato il 27 giugno 2012 dal Consiglio di Stato del Cantone Ticino.
Considerando:
che il 16 marzo 2011 il Gran Consiglio del Cantone Ticino ha adottato la legge sulla collaborazione fra la Polizia cantonale e le Polizie comunali (LCPol) e, il 27 giugno 2012, il Consiglio di Stato il relativo regolamento;
che questi atti normativi sono stati pubblicati nel Bollettino ufficiale delle leggi e degli atti esecutivi del 3 luglio 2012 (n. 28/2012, pag. 249 segg., rispettivamente pag. 253 segg.) e che il 27 giugno 2012 il Governo cantonale ha fissato l'entrata in vigore della LCPol e del relativo regolamento al 1° settembre 2012;
che avverso questi atti normativi il Comune di Giubiasco presenta un ricorso in materia di diritto pubblico al Tribunale federale (art. 82 lett. b LTF), chiedendo di annullare l'art. 2 cpv. 2 e cpv. 3, nonché l'art. 3 cpv. 3 del regolamento;
che con decreto presidenziale del 29 agosto 2012 la domanda di conferire l'effetto sospensivo al gravame è stata respinta;
che con scritto del 4 settembre 2012 il ricorrente, rinviando a una transazione sottoscritta con il Consiglio di Stato ha dichiarato di ritirare il gravame;
che il giudice dell'istruzione decide quale giudice unico circa lo stralcio delle cause ritirate (art. 32 cpv. 1 e 2 LTF) e, in tale ambito, statuisce sulle spese giudiziarie;
che, in caso di desistenza, il Tribunale federale può rinunciare in tutto o in parte a riscuotere le spese giudiziarie (art. 66 cpv. 2 LTF), di massima non addossate ai comuni (art. 66 cpv. 4 LTF);
che, nella fattispecie, il ricorrente non si è avvalso dell'assistenza di un legale e che comunque, l'esito del gravame essendo peraltro aperto, avendo il Comune agito nell'esercizio delle sue attribuzioni ufficiali, non gli spetterebbero le ripetibili richieste della sede federale (art. 68 cpv. 3 LTF; DTF 134 II 117);
per questi motivi, il Presidente decreta:

La causa è stralciata dai ruoli a seguito del ritiro del ricorso.
2.
Non si prelevano spese giudiziarie e non si attribuiscono ripetibili della sede federale.
3.
Comunicazione al ricorrente e al Consiglio di Stato del Cantone Ticino, per sé e per il Gran Consiglio.
