Kernrechtsfrage
Whether the sealing request was admissibly denied and the materials released for search
Extrahierter Entscheid
The sealing refusal and release for search were upheld; a cohabiting spouse with evidentiary privilege has no absolute right to block seizure and search of jointly held items.
Extrahierte Begründung
The privilege protects against compelled active cooperation in incrimination, but not against passive tolerance of seizure. Joint possession in the shared household does not by itself create a search ban; otherwise searches would be systematically frustrated. Only items in the exclusive possession of the privilege-holder, such as private correspondence or highly personal records, may be protected.
