X. appealed to the Federal Supreme Court against the rejection of family reunification for his wife. After the Migration Office indicated it would reconsider its refusal, X. withdrew the appeal. The President of the Second Public Law Division therefore struck the proceedings off as moot. The court refused to treat X. as the prevailing party because he had withdrawn before judgment, but granted his request for free legal aid and appointed Bettina Surber as counsel, paying her CHF 1,500 and charging no court costs.
Art. 32 Abs. 2 BGG; withdrawal of the appeal renders the federal proceedings moot and leads to striking the case off the list. A party who withdraws the appeal before judgment is not to be treated as prevailing, irrespective of the reasons for withdrawal. Free legal aid and appointment of counsel may nevertheless be granted under Art. 64 Abs. 3 BGG where the statutory conditions are met; in that event no court costs are levied and counsel is compensated from the court treasury.

Nach Einsicht
in das Urteil des Verwaltungsgerichts des Kantons St. Gallen vom 15. Oktober 2012, womit die Beschwerde gegen die Verweigerung des Nachzugs der Gattin von X.________ abgelehnt wurde,
in dessen hiergegen gerichtete Eingabe vom 19. November 2012,
in das Schreiben von X.________ vom 9. Juli 2013, wonach er seine Beschwerde zurückziehe, da sich das Migrationsamt des Kantons St. Gallen inzwischen bereit erklärt habe, seine negative Verfügung in Wiedererwägung zu ziehen,
in Erwägung,
dass gestützt auf den Beschwerderückzug das bundesgerichtliche Verfahren hinfällig geworden und durch den Präsidenten als Instruktionsrichter als gegenstandslos abzuschreiben ist (Art. 32 Abs. 2 BGG),
dass entgegen dem Antrag des Beschwerdeführers er nicht als obsiegend gelten kann, da er seine Eingabe vor Erlass des Urteils zurückgezogen hat und keine Rolle spielt, aus welchem Grund dies geschehen ist,
dass jedoch seinem Gesuch um unentgeltliche Rechtspflege und Verbeiständung entsprochen werden kann (vgl. Art. 64 Abs. 3 Satz 3 BGG),
Das Verfahren wird als gegenstandslos abgeschrieben.
Das Gesuch um unentgeltliche Rechtspflege und Verbeiständung wird gutgeheissen.
2.1. Es werden keine Kosten erhoben.
2.2. Dem Beschwerdeführer wird Rechtsanwältin Bettina Surber als unentgeltliche Rechtsvertreterin beigegeben und aus der Bundesgerichtskasse mit Fr. 1'500.-- entschädigt.
Diese Verfügung wird den Verfahrensbeteiligten, dem Verwaltungsgericht des Kantons St. Gallen und dem Bundesamt für Migration schriftlich mitgeteilt.

The proceedings were struck off as moot because the appellant withdrew the appeal before judgment.
Once the appeal was withdrawn, the federal proceedings became devoid of purpose and had to be discontinued as moot under Art. 32(2) BGG.
Whether the appellant should be treated as the prevailing party despite withdrawal
No. The appellant could not be considered successful because he withdrew the appeal before judgment, regardless of why he did so.
The court held that the reason for the withdrawal is irrelevant once the appeal is withdrawn before judgment.
Whether legal aid and appointed counsel should be granted
Yes. The request for free legal aid and legal representation was granted.
The court found the request could be approved under Art. 64(3) third sentence BGG.
