Omnilex-Zusammenfassung

The appellant sought to challenge the Federal Administrative Court’s dismissal of his appeal against a migration office decision refusing to enter into a new asylum application and ordering removal. The Federal Supreme Court held that the remedy in public law matters was barred by the asylum exclusion provisions of the BGG and that the subsidiary constitutional complaint was unavailable against a federal administrative judgment. The appeal was therefore manifestly inadmissible and not entered into in simplified proceedings. Court costs of CHF 300 were charged to the appellant.

Omnilex-Regeste

Art. 83 lit. d Ziff. 1, Art. 83 lit. c Ziff. 3 and 4, Art. 113, Art. 108 Abs. 1 lit. a and Art. 108 BGG; admissibility of remedies in asylum matters. A judgment of the Federal Administrative Court rendered in an asylum procedure is excluded from the appeal in public law matters. This applies in particular where provisional admission and removal are at issue. A subsidiary constitutional complaint is not available against federal administrative judgments, but only against final cantonal decisions. If inadmissibility is manifest, the Federal Supreme Court may decline to enter in simplified proceedings under Art. 108 BGG; costs follow the outcome under Art. 65 and 66 BGG.

Urteil vom 20. Oktober 2011
II. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Zünd, Präsident,
Gerichtsschreiber Feller.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Bundesamt für Migration, Quellenweg 6, 3003 Bern.

Gegenstand
Vollzug der Wegweisung,

Beschwerde gegen das Urteil des Bundesverwaltungsgerichts, Abteilung IV, vom 3. Oktober 2011.

Erwägungen:

1.

Kernrechtsfrage

Whether the appeal in public law matters was admissible against the Federal Administrative Court judgment in an asylum case involving removal and provisional admission.

Extrahierter Entscheid

The appeal was inadmissible because the case fell under asylum and was excluded by Art. 83 lit. d ch. 1 BGG; the additional exclusion grounds for provisional admission and removal also applied.

Extrahierte Begründung

The disputed judgment was rendered in the second asylum procedure and therefore concerned asylum law. In addition, the challenged matters involved provisional admission and removal, which are separately excluded from ordinary public-law appeal. A subsidiary constitutional complaint was also unavailable because it lies only against final cantonal decisions.

Kernrechtsfrage

Whether a subsidiary constitutional complaint could be entertained.

Extrahierter Entscheid

No; such a remedy is available only against final cantonal decisions, not against a Federal Administrative Court judgment.

Extrahierte Begründung

The statutory prerequisites for subsidiary constitutional review were absent, so the filing could not be treated as such a remedy.

Kernrechtsfrage

Allocation of court costs.

Extrahierter Entscheid

Court costs were imposed on the appellant in the amount of CHF 300.

Extrahierte Begründung

Costs follow the outcome of the proceedings.
