X. SA appealed a Geneva labor court judgment, then withdrew its appeal by letter of 8 January 2008. The Federal Supreme Court took note of the withdrawal under Art. 32(2) LTF, struck the case from the docket, and ordered judicial costs of CHF 500 against the appellant.
Art. 32 al. 2 LTF; withdrawal of an appeal and termination of proceedings. When the appellant withdraws the appeal, the Federal Supreme Court takes note of the withdrawal ex officio, strikes the case from the docket and ends the proceedings without examining the merits. The court took note of the withdrawal and ordered the case to be removed from the docket.
