Three appellants challenged a Ticino cantonal appeal judgment in an organ-liability dispute. After the Federal Supreme Court had already rejected their request for suspensive effect, the parties informed the court that they had settled the dispute and agreed to waive party compensation at federal level. The court accepted the joint request and struck the case from the docket. It ordered federal court costs of CHF 1,000, payable jointly and severally by the appellants.
Art. 32 cpv. 2 LTF; strike-out of proceedings after settlement; costs under Arts. 65 and 66 LTF: where the parties notify the Federal Supreme Court that they have settled the dispute and jointly request discontinuance, the court may remove the case from the docket without further examination of the merits. In such circumstances, the allocation of judicial costs follows the general rules on court fees and cost apportionment, and a waiver of party compensation by agreement is respected. The settlement does not imply a substantive ruling on the challenged cantonal judgment (consid. 1).

Il presidente, visto:
che con sentenza del 6 agosto 2007 la II Camera civile del Tribunale d'appello del Cantone Ticino ha, fra l'altro, condannato - in solido con altri obbligati - I.________ al pagamento di fr. 2'104'519.--, H.________ e L.________ al pagamento di fr. 1'346'641.-- ciascuno, tutti con interessi al 5% dal 18 settembre 1997;
che contro questa decisione I.________, H.________ e L.________ sono insorti dinanzi al Tribunale federale, il 17 settembre 2007, con un ricorso in materia civile volto ad ottenere, previa concessione dell'effetto sospensivo al gravame, la modifica della sentenza cantonale nel senso della reiezione della petizione nei loro confronti;
che i ricorrenti hanno versato l'anticipo spese di fr. 19'000.-- entro il termine loro assegnato;
che l'istanza tendente al conferimento dell'effetto sospensivo è stata respinta il 17 ottobre 2007;
che nella risposta del 22 novembre 2007 l'opponente ha proposto la reiezione del gravame;
che con lettera del 7 dicembre 2007 i patrocinatori delle parti hanno comunicato al Tribunale federale di aver posto fine alla vertenza oggetto del ricorso mediante la stipulazione di un accordo transattivo, nell'ambito del quale hanno anche convenuto di rinunciare al versamento di ripetibili della sede federale;
ch'essi domandano quindi di stralciare la causa dai ruoli;
considerando:
che nelle circostanze appena descritte la richiesta può senz'altro essere accolta (art. 32 cpv. 2 LTF);
che per le spese giudiziarie si rinvia all'art. 65 cpv. 1, cpv. 2 e cpv. 3 lett. b nonché all'art. 66 cpv. 2, cpv. 3 e cpv. 5 LTF;
decreta:

La causa 4A_377/2007 è stralciata dai ruoli a seguito della transazione.
2.
Le spese giudiziarie di fr. 1'000.-- sono poste a carico dei ricorrenti, in solido.
3.
Comunicazione ai patrocinatori delle parti e alla II Camera civile del Tribunale d'appello del Cantone Ticino.

Whether the appeal should be struck from the docket after the parties settled the dispute
Yes. The request to strike the case from the docket could be granted because the parties informed the court that they had concluded a settlement resolving the dispute.
Once the parties settle the matter and jointly request withdrawal/striking out, there is no need to continue the proceedings; the court accepted the request under Art. 32(2) LTF.
Who bears the federal court costs after the settlement
The appellants must bear the court costs jointly and severally in the amount of CHF 1,000.
The court allocated the costs according to the cited provisions on judicial fees and cost allocation; the parties had also waived party compensation at the federal level.
