In a written order, the Federal Supreme Court noted that the appellant had withdrawn his civil appeal against the Fribourg cantonal appellate judgment concerning abusive termination of an employment contract. The court therefore struck the case from the docket. It also ordered judicial costs of CHF 200 against the appellant. Prior requests for total legal aid had been rejected, and an advance on costs had been ordered before the withdrawal was filed.
Art. 32 al. 2 LTF; withdrawal of an appeal before the Federal Supreme Court: the Court takes note of the withdrawal and removes the case from the docket. The discontinuance does not preclude the allocation of judicial costs, which are borne by the withdrawing appellant according to Art. 65 and 66 LTF. l'ordonnance présidentielle du 15 novembre 2007 invitant le recourant à verser une avance de frais de 800 fr. jusqu'au 30 novembre 2007, puis, par prolongation de délai accordée le 4 décembre 2007, jusqu'au 17 décembre 2007;
la lettre du 17 décembre 2007 par laquelle le mandataire du recourant déclare retirer le recours;
considérant:
qu'il y a lieu de prendre acte de ce retrait et de rayer la cause du rôle (art. 32 al. 2 LTF);
que le recourant supporte les frais judiciaires (art. 65 al. 1 et 4 let. c et 66 al. 2 et 3 LTF);
par ces motifs, la Juge unique ordonne:

Il est pris acte du retrait du recours en matière civile.
2.
La cause 4A_378/2007 est rayée du rôle.
3.
Les frais judiciaires, arrêtés à 200 fr., sont mis à la charge du recourant.

La présente ordonnance est communiquée en copie aux mandataires des parties et à la IIe Cour d'appel civil du Tribunal cantonal de l'Etat de Fribourg.

Whether to take note of the withdrawal of the civil appeal and remove the case from the docket
The court took note of the withdrawal and struck the case from the docket.
Once the appellant's counsel declared the appeal withdrawn, the court had to record the withdrawal and discontinue the proceeding.
Allocation of judicial costs after withdrawal
The judicial costs were imposed on the appellant and set at CHF 200.
Because the appeal was withdrawn, the appellant had to bear the costs under the Federal Supreme Court rules cited by the court.
