Omnilex-Zusammenfassung

The Federal Supreme Court dealt with an employment case in which the defendant had filed both a public-law appeal and a reform appeal against a cantonal appellate judgment. Because the public-law appeal was upheld on the same day and the cantonal decision was annulled, the reform appeal no longer had an object and was removed from the docket. The Court then allocated costs on the basis of the situation before mootness, holding the appellant responsible for the judicial fee and party compensation because it had caused unnecessary costs.

Omnilex-Regeste

Art. 57 al. 5 OJ; after admission of a public-law appeal and annulment of the cantonal decision, a parallel reform appeal loses its object and is struck from the roll. Costs are determined according to the situation prevailing before mootness; under Art. 156(6) OJ, unnecessary costs are borne by the party that caused them, with reference to Art. 40 OJ and Art. 72 PCF. The allocation is not governed by the substantive success of the moot appeal but by the causal responsibility for the unnecessary procedural expense.

Qu'il doit être rayé du rôle;

Kernrechtsfrage

Whether the reform appeal remained pending after the public-law appeal was upheld and the cantonal decision annulled

Extrahierter Entscheid

The reform appeal became moot because the cantonal decision had already been annulled by the successful public-law appeal; it was removed from the docket.

Extrahierte Begründung

Under the usual sequence in Art. 57(5) OJ, the public-law appeal is examined first. Once that appeal was granted and the challenged cantonal decision annulled, there was no longer an extant decision for the reform appeal to attack.

Kernrechtsfrage

Allocation of costs after the reform appeal became moot

Extrahierter Entscheid

Costs were allocated according to the situation existing before mootness; the appellant had to bear the judicial fee and pay party compensation because it caused unnecessary costs.

Extrahierte Begründung

The court relied on Art. 40 OJ and Art. 72 PCF, together with Art. 156(6) OJ, which places unnecessary costs on the party that caused them.
