la demande d'assistance judiciaire présentée par le recourant dans le cadre de cette procédure;
l'ordonnance du 16 octobre 2008 par laquelle la Ire Cour de droit civil a rejeté cette requête;
l'ordonnance présidentielle du 4 novembre 2008 invitant le recourant à verser une avance de frais de 1'000 fr. jusqu'au 19 novembre 2008, puis, à la suite de deux prolongations de délai, jusqu'au 9 janvier 2009;
la lettre du 9 janvier 2009 par laquelle le mandataire du recourant déclare retirer le recours;
considérant:
qu'il y a lieu de prendre acte de ce retrait et de rayer la cause du rôle (art. 32 al. 2 LTF);
que le recourant supporte les frais judiciaires (art. 65 al. 1 et 3 let. b et 66 al. 2 et 3 LTF);
par ces motifs, le Juge unique ordonne:

La cause 4D_104/2008 est rayée du rôle.
2.
Les frais judiciaires, arrêtés à 200 fr., sont mis à la charge du recou-rant.
3.
La présente ordonnance est communiquée aux mandataires des parties et à la Chambre des révisions civiles et pénales du Tribunal cantonal du canton de Vaud.

Whether the constitutional complaint should be struck from the docket after withdrawal
The court took note of the withdrawal and struck the case from the docket.
Once the appellant declared withdrawal, there was no need to decide the merits; the proceedings were terminated by strike-out under Art. 32(2) LTF.
Who must bear the court costs after the withdrawal
The appellant must bear the judicial costs, set at CHF 200.
Because the appeal was withdrawn, the appellant was charged with the costs under the Federal Supreme Court Act provisions on costs.
