Whether the recourse should be taken off the docket after withdrawal
The court took formal notice of the withdrawal and struck the case from the roll.
Because the appellant declared in writing that it was withdrawing the recourse, the court applied Art. 32(2) LTF and terminated the proceedings without a merits review.
Allocation of judicial costs after withdrawal
Judicial costs were set at CHF 200 and charged to the appellant.
After the withdrawal of the recourse, the costs were imposed on the withdrawing party.
