Late appeal; no entry and no legal aid

Omnilex-Zusammenfassung

The Federal Supreme Court dealt with an appeal against a cantonal decision on legal aid in matrimonial protection proceedings. It held that the appeal was filed too late: the cantonal judgment had been served on 18 February 2014, but the appeal was only posted on 30 April 2014. The filing was therefore manifestly inadmissible, and the Court did not enter into the matter. Because the appeal had no prospects of success, the request for legal aid in the federal proceedings was denied. Court costs of CHF 300 were imposed on the appellant.

Omnilex-Regeste

Arts. 100 Abs. 1, 48 Abs. 1 and 108 Abs. 1 lit. a BGG; timeliness of appeal and summary non-entry proceedings. An appeal must be filed within the statutory period by delivery to the Federal Supreme Court or timely handover to the post; if the deadline is missed, the appeal is manifestly inadmissible and no entry is made under the summary procedure. A legal-aid request under Art. 64 Abs. 1 BGG fails where the appeal is hopeless, including where it is time-barred and does not satisfy the minimal reasoning requirements of Arts. 42 Abs. 2 and 106 Abs. 2 BGG. The unsuccessful appellant bears the costs under Art. 66 Abs. 1 BGG (consid. 1-3).

Urteil vom 2. Mai 2014

II. zivilrechtliche Abteilung

Besetzung
Bundesrichter von Werdt, Präsident,
Gerichtsschreiber Füllemann.

Verfahrensbeteiligte
X.________,
Beschwerdeführerin,

gegen

Amtsgerichtsstatthalter von Y.________.

Gegenstand
Unentgeltliche Rechtspflege (Eheschutz),

Beschwerde nach Art. 72 ff. BGG gegen das Urteil
vom 17.

in Erwägung,

Kernrechtsfrage

Whether the appeal was filed within the statutory deadline and could be heard.

Extrahierter Entscheid

The appeal was filed after expiry of the 30-day time limit and was therefore inadmissible; the Court made no entry.

Extrahierte Begründung

The cantonal judgment was served on 2014-02-18, while the appeal was handed to the post only on 2014-04-30. It was thus late under Arts. 100(1) and 48(1) BGG and manifestly inadmissible under Art. 108(1)(a) BGG.

Kernrechtsfrage

Whether the appellant qualified for legal aid for the federal proceedings.

Extrahierter Entscheid

Legal aid was denied because the appeal had no prospects of success.

Extrahierte Begründung

Since the appeal was time-barred and, additionally, did not meet the reasoning requirements of Arts. 42(2) and 106(2) BGG, it was hopeless within the meaning of Art. 64(1) BGG.

Kernrechtsfrage

Whether court costs should be imposed on the appellant.

Extrahierter Entscheid

Court costs were charged to the appellant as the losing party.

Extrahierte Begründung

Under Art. 66(1) BGG, the unsuccessful party bears the costs.
