The Federal Supreme Court noted the appellant's withdrawal of the appeal against the Vaud cantonal civil judgment and removed the case from the docket. It also ordered the appellant to bear the federal judicial costs, fixed at CHF 300. The proceedings had previously been suspended pending the outcome of a cantonal remedy.

Upon valid withdrawal of a pending appeal, the court merely takes note thereof and removes the case from the roll. The proceedings end without a substantive examination. Under Art. 5 para. 2 PCF by analogy via Art. 71 LTF and Art. 66 paras. 1 and 2 LTF, the judicial costs are borne by the withdrawing appellant, unless special circumstances justify a different allocation.

par ces motifs, la Juge présidante ordonne:

Il est pris acte du retrait du recours et la cause est rayée du rôle.

Les frais judiciaires, arrêtés à 300 fr., sont mis à la charge du recourant.

La présente ordonnance est communiquée aux participants à la procédure et à la Cour civile du Tribunal cantonal du canton de Vaud.

Whether the withdrawn appeal should be struck from the docket
The Court took note of the withdrawal and removed the case from the docket.
Once the appellant declared withdrawal, the proceedings no longer had to be continued; the court merely recorded the withdrawal and struck the case.
