The Federal Supreme Court took note of the appellant’s withdrawal of his civil appeal against a decision of the public law chamber of the Neuchâtel administrative court. The single judge struck the case from the docket, rejected the pending request for legal aid, and ordered judicial costs of CHF 300 against the appellant. No costs were awarded to the respondent, who had merely submitted a short statement leaving the matter to the court’s discretion.
Art. 73 PCF in conjunction with Art. 71 LTF; withdrawal of the appeal and procedural consequences. When a federal appeal is withdrawn, the court takes note of the withdrawal and removes the case from the docket. The instructing judge is competent to issue the order under Art. 32 para. 2 LTF. A party who withdraws the appeal cannot obtain legal aid; the costs are borne by that party pursuant to Art. 5 para. 2 PCF in conjunction with Art. 71 LTF and Art. 66 paras. 1 and 2 LTF. Court fees are fixed having regard to the work already performed under Art. 65 LTF. If the withdrawal occurs before substantial work on the merits, no party costs are awarded to the respondent.

la détermination de l'intimé du 2 février 2011;
la déclaration de retrait de A.________ du 22 novembre 2011, postée le lendemain;
considérant:
qu'il convient de prendre acte de ce retrait et de rayer la cause du rôle (art. 73 PCF par renvoi de l'art. 71 LTF);
que le juge instructeur est compétent pour statuer à cet effet (art. 32 al. 2 LTF);
que le recourant s'étant désisté, l'assistance judiciaire ne peut lui être octroyée et les frais doivent être mis à sa charge (art. 5 al. 2 PCF par renvoi de l'art. 71 LTF; art. 66 al. 1 et 2 LTF);
que l'émolument judiciaire doit être fixé en tenant compte de l'activité déployée jusqu'à ce jour par la Cour de céans (art. 65 LTF);
que, en l'espèce, le retrait est intervenu avant que le juge instructeur ne se saisisse de l'affaire;
qu'il n'y a pas lieu d'allouer de dépens à l'intimé, qui s'en est remis, dans une courte lettre, à « la sagesse légendaire du Tribunal fédéral »;
par ces motifs, le Juge instructeur ordonne:

Il est pris acte du retrait du recours et la cause est rayée du rôle.
2.
La demande d'assistance judiciaire est rejetée.
3.
Les frais judiciaires, arrêtés à 300 fr., sont mis à la charge du recourant.
4.
La présente ordonnance est communiquée aux parties et à la Cour de droit public du Tribunal administratif du canton de Neuchâtel.
