In an appeal concerning notice of receipt of a request for sale in debt-enforcement proceedings, the appellant withdrew the appeal on 6 October 2010. The Federal Supreme Court, acting through the instructing judge, took note of the withdrawal and struck the case from the roll. Court costs of CHF 300 were charged to the appellant, reduced in view of the withdrawal, and no party compensation was awarded to the respondent because his opposition to suspensive effect had been unfounded.

Vu:
le recours en matière civile du 16 août 2010;
l'ordonnance du 6 septembre 2010 admettant la requête d'effet suspensif du recourant;
la déclaration de retrait de recours du 6 octobre 2010;
considérant:
qu'il convient de prendre acte du retrait de recours et de rayer la cause du rôle;
que le juge instructeur est compétent pour statuer à cet effet (art. 32 al. 2 LTF);
que, selon la pratique constante, les frais judiciaires - toutefois réduits (art. 66 al. 2 LTF) - incombent à la partie qui retire son recours;
que l'intimé s'est opposé à tort à la requête d'effet suspensif et, partant, qu'il n'y a pas lieu de lui allouer de dépens;
par ces motifs, le Juge instructeur ordonne:

La cause est rayée du rôle par suite de retrait du recours.
2.
Les frais judiciaires, arrêtés à 300 fr., sont mis à la charge du recourant.
3.
Il n'est pas alloué de dépens à l'intimé.
4.
La présente ordonnance est communiquée aux parties, à l'Office des poursuites de Genève et à la Commission de surveillance des offices des poursuites et des faillites du canton de Genève.

Whether the withdrawn appeal should be struck from the docket
The court took note of the withdrawal and ordered the case struck from the roll.
The withdrawal ended the proceedings; the instructing judge was competent to decide this consequence under Art. 32(2) LTF.
Allocation of court costs after withdrawal of the appeal
Court costs were imposed on the appellant, reduced to CHF 300.
Under the Federal Supreme Court's settled practice, the party withdrawing the appeal bears the judicial costs, albeit reduced under Art. 66(2) LTF.

No party costs were awarded to the respondent.
The respondent had wrongly opposed the request for suspensive effect, so no indemnity was due.
