Kernrechtsfrage
Can an architect’s plan serve as a plan for the land register under Art. 732(2) ZGB for a partial easement location?
Extrahierter Entscheid
No. A plan for the land register must be an extract based on the official surveying data; a privately prepared architect’s plan does not suffice.
Extrahierte Begründung
Art. 732(2) ZGB, read with Art. 950 ZGB, Art. 29 GeoIG, Art. 2 lit. f GBV and Art. 7(1) VAV, requires a graphical extract from the official cadastral data. The purpose is reliability and public faith of the land register. Private plans may be annotated by the parties, but they are not extracts from the official survey and cannot replace them.
