The appellant withdrew her civil appeal against a decision of the Geneva Civil Chamber concerning an advance on court fees in an avoidance action. The Federal Supreme Court took note of the withdrawal and struck the case from the roll. It also ordered the appellant to pay a judicial fee of CHF 300. The order was issued by the President of the Second Civil Law Court.
Art. 73 PCF in conjunction with Art. 71 LTF; Art. 32 al. 2 LTF: upon withdrawal of an appeal, the Federal Supreme Court takes note of the withdrawal and strikes the cause from the roll. The proceedings are thereby terminated without a merits decision. Under Art. 5 al. 2 PCF in conjunction with Art. 71 LTF and Art. 66 al. 1 LTF, the judicial fee is generally borne by the withdrawing appellant.
