Omnilex-Zusammenfassung

A. appealed to the Federal Court against a Ticino appellate judgment in a possessory action and against the refusal of legal aid. The Federal Court held that possessory judgments under Art. 927(1) CC are not final decisions and therefore cannot be attacked by reform appeal. It further stated that the appellant could not challenge factual findings or cantonal procedural law in this remedy. Conversion into a public law appeal was excluded because the brief had been drafted by a professional lawyer, and in any event the filing did not meet the reasoning requirements of Art. 90(1)(b) OG. The appeal was declared inadmissible and the appellant was ordered to pay CHF 1,000 in costs.

Omnilex-Regeste

Art. 48 OG; Art. 55 cpv. 1 lett. c OG; Art. 90 cpv. 1 lett. b OG; Art. 156 cpv. 1 OG: Admissibility of a reform appeal and limits of review. Possessory judgments under Art. 927 cpv. 1 CC are not final decisions and are therefore not susceptible to reform appeal. In such proceedings, the Federal Court does not review the cantonal findings of fact or the application of cantonal procedural law. Conversion into a public law appeal is excluded when the filing has been drafted by a professional representative; in any event, the constitutional complaint must satisfy the strict reasoning requirements of Art. 90 cpv. 1 lett. b OG. Costs follow the event.

II CORTE CIVILE

6 aprile 2001

Composizione della Corte: giudici federali Reeb, presidente,
Raselli e Nordmann.
Cancelliere: Piatti.

_______
Visto il ricorso per riforma del 19 febbraio 2001 presentato da A.________, attore, patrocinato dall'avv. Stefano Zanetti, Bellinzona, contro la sentenza emanata il 19 gennaio 2001 dalla I Camera civile del Tribunale d'appello del Cantone Ticino nella causa che oppone il ricorrente a B.________, convenuto, patrocinato dall'avv. Alberto Augustoni, Bellinzona, in merito a un'azione possessoria;

Ritenuto in fatto e considerando in diritto:
che il 21 aprile 2000 il Segretario assessore della Pretura di Bellinzona ha parzialmente accolto l'azione possessoria inoltrata da A.________ nei confronti di B.________ e ha respinto la domanda di assistenza giudiziaria presentata dall'attore;
che con sentenza 19 gennaio 2001 la I Camera civile del Tribunale d'appello del Cantone Ticino, adita da A.________, ha respinto sia l'appello introdotto contro il giudizio sull'azione possessoria sia quello diretto contro il diniego dell'assistenza giudiziaria;
che il 19 febbraio 2001 A.________ ha inoltrato al Tribunale federale contro la predetta sentenza un ricorso per riforma, con cui postula la restituzione di tutti gli oggetti di sua proprietà ancora in possesso del convenuto, la condanna di quest'ultimo al pagamento di fr. 18'200.-- nonché la notifica della comminatoria dell'art. 292 CP;
che con decisione 2 marzo 2001 la II Corte civile del Tribunale federale ha respinto, per mancanza di possibilità di esito favorevole del gravame, una domanda di assistenza giudiziaria presentata dal ricorrente;
che innanzi tutto le sentenze concernenti azioni possessorie fondate, come quella in discussione, sull'art. 927 cpv. 1 CC non sono finali ai sensi dell'art. 48 OG e non sono pertanto suscettive di un ricorso per riforma (DTF 113 II 243);
che inoltre l'attore misconosce che in un ricorso per riforma non è possibile criticare gli accertamenti di fatto contenuti nella sentenza impugnata né censurare l'applicazione del diritto processuale cantonale (art. 55 cpv. 1 lett. cOG);
che essendo il rimedio stato redatto da un patrocinatore professionista una conversione d'ufficio del gravame in un ricorso di diritto pubblico appare già esclusa per questo motivo (DTF 120 II 270 consid. 2);
che infine, a prescindere dall'appena menzionata circostanza, il gravame non ossequia l'art. 90 cpv. 1 lett. b OG ed è pertanto inidoneo a far apparire arbitraria la sentenza cantonale;
che la tassa di giustizia segue la soccombenza (art. 156 cpv. 1 OG);

Per questi motivi

visto l'art. 36a OG

il Tribunale federale

pronuncia :

  1. Il ricorso è inammissibile.

  2. La tassa di giustizia di fr. 1000.-- è posta a carico del ricorrente.

  3. Comunicazione ai patrocinatori delle parti e alla I Camera civile del Tribunale d'appello del Cantone Ticino.

Kernrechtsfrage

Whether the federal reform appeal was admissible against the cantonal judgment in a possessory action.

Extrahierter Entscheid

The appeal was not admissible because judgments in possessory actions under Art. 927(1) CC are not final within the meaning of Art. 48 OG.

Extrahierte Begründung

The Federal Court held that such possessory judgments are not final decisions for purposes of a reform appeal.

Kernrechtsfrage

Whether the appellant could challenge findings of fact and cantonal procedural law in a reform appeal.

Extrahierter Entscheid

No; those complaints cannot be raised in a reform appeal.

Extrahierte Begründung

A reform appeal does not permit criticism of factual findings or the application of cantonal procedural law.

Kernrechtsfrage

Whether the filing could be converted ex officio into a public law appeal.

Extrahierter Entscheid

No conversion was possible because the remedy had been drafted by a professional representative.

Extrahierte Begründung

The Court considered ex officio conversion excluded on that ground.

Kernrechtsfrage

Whether the filing met the requirements for a public law appeal to challenge arbitrariness.

Extrahierter Entscheid

It did not satisfy Art. 90(1)(b) OG and therefore could not demonstrate arbitrariness.

Extrahierte Begründung

The pleading was insufficiently reasoned under the applicable procedural rule.

Kernrechtsfrage

Who bears the federal court costs.

Extrahierter Entscheid

The appellant bears the court fee of CHF 1,000.

Extrahierte Begründung

Costs follow the event.
