H.X. filed a constitutional complaint against a Vaud cantonal decision granting legal aid in a mainlevée proceeding but imposing a monthly franchise. Before the federal court decided, the cantonal court issued a later merits judgment that materially changed the challenged point. The Federal Supreme Court held that the complaint had become moot and struck the case from the roll. The request for federal legal aid also became moot. Because the canton’s later decision caused the case to become moot and the dispute concerned patrimonial interests of the canton, court costs of CHF 100 were imposed on the Canton of Vaud. No party compensation was awarded since the appellant was unrepresented.
Art. 66 para. 4 LTF; mootness of a constitutional complaint after a later cantonal decision modifies the challenged dispositive point. If the impugned decision is materially replaced or altered by a subsequent cantonal judgment so that no live controversy remains, the federal appeal becomes without object and is struck from the docket. The legal-aid request attached to such an appeal likewise becomes moot. Where the mootness is attributable to the canton and the dispute concerns patrimonial interests of the canton, the court costs are charged to that canton. Party compensation is not awarded to a self-represented appellant (cf. consid. 1-4).

Vu:
le recours formé le 21 mars 2013 par H.X.________ contre la décision rendue le 13 février 2013 par le Président de la Cour des poursuites et faillites du Tribunal cantonal vaudois, laquelle accorde au recourant l'assistance judiciaire avec effet au 22 janvier 2013 dans la procédure de mainlevée qui l'oppose à la Confédération suisse, mais l'astreint à payer une « franchise mensuelle » de 50 fr. dès et y compris le 1er mars 2013;
l'arrêt de la Cour des poursuites et faillites du Tribunal cantonal vaudois du 11 mars 2013 rejetant le recours de H.X.________ contre le prononcé de la mainlevée définitive et précisant que le « bénéficiaire de l'assistance judiciaire [...] est, dans la mesure de l'art. 123 CPC, tenu au remboursement des frais judiciaires mis à la charge de l'Etat »;
l'arrêt de la IIe Cour de droit civil du Tribunal fédéral du 16 juillet 2013 rejetant le recours constitutionnel de H.X.________ à l'encontre de cet arrêt (5D_96/2013);
l'ordonnance présidentielle du 10 avril 2013 accordant l'effet suspensif au recours;
que, par l'arrêt sur le fond du 11 mars 2013, l'autorité cantonale a modifié matériellement le chiffre du dispositif de la décision présentement attaquée, qui avait astreint le recourant à s'acquitter d'une « franchise mensuelle » de 50 fr. dès et y compris le 1er mars 2013;
que, dans ces conditions, le recours n'a plus d'objet ( cf. ordonnance 9C_632/2011 du 25 novembre 2011);
qu'il incombe en principe à l'autorité cantonale, dont la décision a rendu sans objet le recours, de répondre des conséquences financières de la procédure;
que, cela étant, la requête d'assistance judiciaire du recourant est devenue sans objet (ATF 136 I 129 consid. 10);
que le présent litige met en cause l'intérêt patrimonial du canton (art. 66 al. 4 LTF), de sorte que l'émolument judiciaire doit être mis à la charge de celui-ci ( cf. Corboz, in : Commentaire de la LTF, 2009, n° 29in fine ad art. 66);
que, en revanche, le recourant ne peut prétendre à des dépens, car il a procédé sans le concours d'un avocat (ATF 135 III 127 consid. 4);
Le recours est déclaré sans objet et la cause est rayée du rôle.
La requête d'assistance judiciaire du recourant est sans objet.
Les frais judiciaires, arrêtés à 100 fr., sont mis à la charge du canton de Vaud.
Il n'est pas alloué de dépens au recourant.
La présente ordonnance est communiquée aux parties.
