The Federal Supreme Court took note of the applicant’s withdrawal of his revision request in inheritance proceedings and ordered the case struck from the docket. After denying legal aid and requesting an advance on costs, the court held that the matter was terminated by withdrawal. The applicant was ordered to pay a judicial fee of CHF 300. The decision was communicated to the parties’ counsel and to the Vaud cantonal appeals chamber.

Once the applicant withdraws the request, the Federal Supreme Court takes note of the withdrawal and strikes the case from the docket; no further substantive adjudication is rendered. Costs are borne by the withdrawing party under Art. 5 al. 2 PCF in conjunction with Art. 71 LTF and Art. 66 al. 1 LTF. The procedural consequence of withdrawal is a discontinuance of the revision proceedings, subject to allocation of judicial costs to the requester (consid. 1-2).

l'ordonnance présidentielle du 27 avril 2007 invitant le requérant à verser une avance de frais de 1'000 fr. dans les 5 jours;
la déclaration de retrait de la demande de révision du 2 mai 2007;
Considérant:
qu'il convient de prendre acte de ce retrait et de rayer la cause du rôle (art. 73 PCF par renvoi de l'art. 71 LTF; art. 32 al. 2 LTF);
que les frais doivent être mis à la charge du requérant (art. 5 al. 2 PCF par renvoi de l'art. 71 LTF; art. 66 al. 1 LTF);
Par ces motifs, le Président de la IIe Cour de droit civil:

Prend acte du retrait de la demande de révision et ordonne la radiation de la cause du rôle.
2.
Met un émolument judiciaire de 300 fr. à la charge du requérant.
3.
Communique la présente ordonnance en copie aux mandataires des parties et à la Chambre des recours du Tribunal cantonal du canton de Vaud.

Whether the withdrawn revision request should be noted and the case struck from the docket
The withdrawal was taken on record and the case was removed from the docket.
Once the requester withdrew the revision request, the court merely had to note the withdrawal and discontinue the matter by striking it from the docket.

The requester must bear the judicial fee.
Costs were charged to the requester under the applicable procedural and Supreme Court cost provisions after withdrawal.
