Omnilex-Zusammenfassung

The appellant challenged a Geneva civil judgment by public law appeal in a divorce dispute. Before deciding that appeal, the Federal Supreme Court had already allowed the related reform appeal, which deprived the public law appeal of any practical purpose. The Court therefore declared the appeal moot and struck it from the docket. It ordered the appellant to pay the judicial fee of CHF 500 and refused to award costs to the respondent, who had not been invited to submit observations.

Omnilex-Regeste

Art. 40 OJ; Art. 72 PCF; mootness of a public law appeal when a parallel reform appeal has been allowed: if a concurrent federal appeal in the same matter already affords the appellant the sought protection, the public law appeal loses its object and is struck from the docket. Costs are borne by the appellant whose filing has become unnecessary. No party compensation is due to the respondent if she was not invited to determine the appeal (Art. 159 al. 1 and 2 OJ).

Composition de la Cour: MM. les Juges Reeb, président,
Bianchi et Meyer. Greffière: Mme Jordan.

__________

Statuant sur le recours de droit public
formé par
X.________, représenté par Me André Malek-Asghar, avocat à Genève,

contre
l'arrêt rendu le 10 novembre 2000 par la Chambre civile de la Cour de justice du canton de Genève dans la cause qui oppose le recourant à dame X.________, née V.________, représentée par Me Jacques Borowsky, avocat à Genève;

(art. 9 Cst. ; divorce, formalisme excessif)

Vu :

que, par arrêt de ce jour, la IIe Cour civile du Tribunal fédéral a admis, dans la mesure de sa recevabilité, le recours en réforme du recourant;

que le recours de droit public est dès lors devenu sans objet;

que, partant, il convient de mettre les frais à la charge du recourant, son procédé étant devenu inutile (art. 40 OJ et 72 PCF);
