Omnilex-Zusammenfassung

The Federal Supreme Court dealt with a public-law appeal against a Geneva order on protective measures of the matrimonial union. The appellant had been ordered to pay an advance on costs of CHF 2,000 by 22 January 2007, under pain of inadmissibility. The advance was not paid. The Court therefore declared the appeal inadmissible under former Art. 150 para. 4 OJ and charged the appellant with a judicial fee of CHF 500.

Omnilex-Regeste

Art. 150 al. 4 OJ; inadmissibility for failure to pay the advance on costs within the prescribed time; if the ordered advance is not paid, the appeal is not entered into and the proceeding is terminated without examination on the merits. The costs of the unsuccessful procedural step are charged to the defaulting party pursuant to Art. 156 al. 1 OJ. Where the contested decision predates 1 January 2007, the former OJ applies by virtue of Art. 132 al. 1 LTF.

Objet
art. 9 Cst. (mesures protectrices de l'union conjugale),

recours de droit public [OJ] contre l'ordonnance du Président du Tribunal de première instance du canton de Genève du 27 novembre 2006.

Vu :
l'acte de recours du 3 janvier 2007;
l'ordonnance du Président de la IIe Cour de droit civil du 5 janvier 2007 fixant au recourant un délai au 22 janvier 2007 pour effectuer une avance de frais de 2'000 fr., conformément à l'art. 150 de la loi fédérale d'organisation judiciaire (OJ), sous peine d'irrecevabilité du recours;
l'avis de la Caisse du Tribunal fédéral du 29 janvier 2007, constatant le défaut de paiement de l'avance de frais;

Considérant:
que la décision attaquée étant antérieure au 1er janvier 2007, l'ancien droit (OJ) est applicable en vertu de l'art. 132 al. 1 de la loi fédérale du 17 juin 2005 sur le Tribunal fédéral (LTF; RS 173.110);

Kernrechtsfrage

Whether the public-law appeal had to be entered into despite non-payment of the advance on costs.

Extrahierter Entscheid

No. Because the advance on costs was not paid within the time limit, the appeal was inadmissible.

Extrahierte Begründung

The Federal Supreme Court held that the advance had been ordered under former Art. 150 OJ and remained unpaid; under Art. 150 para. 4 OJ the appeal must therefore be declared inadmissible, with costs borne by the appellant.

Kernrechtsfrage

Who must bear the court costs caused by the inadmissible appeal?

Extrahierter Entscheid

The appellant must bear the judicial fee of CHF 500.

Extrahierte Begründung

Since the appeal was inadmissible for non-payment, the costs follow against the appellant under Art. 156 para. 1 OJ.
