Omnilex-Zusammenfassung

The Federal Supreme Court held that the appellant’s submissions were inadmissible because he attacked the merits of the refusal of conditional release instead of the only matter decided by the cantonal court, namely the formal inadmissibility of his cantonal appeal. He also failed to establish that the cantonal finding that no supplementary motivation had been filed was arbitrary. The federal appeal was therefore declared inadmissible, and the appellant was ordered to pay reduced court costs of CHF 500.

Omnilex-Regeste

Art. 80 al. 1 LTF, art. 105 al. 2 LTF; scope of federal review and challenge to factual findings. The Federal Supreme Court reviews only the subject matter determined by the challenged decision; arguments addressing a different issue are inadmissible. A party seeking to depart from cantonal factual findings must specifically demonstrate arbitrariness; bare assertions, unsupported by evidence, do not suffice. Where the appeal is inadmissible and the appellant’s financial circumstances are limited, court costs may be reduced pursuant to Art. 66 al. 1 LTF.

Arrêt du 26 février 2014

Cour de droit pénal

Composition
M. le Juge fédéral Schneider, Juge unique.
Greffière: Mme Gehring.

Participants à la procédure
X.________,
recourant,

contre

Kernrechtsfrage

Admissibility of the federal appeal despite challenging the merits instead of the cantonal inadmissibility ruling

Extrahierter Entscheid

The appeal was inadmissible because the appellant attacked the refusal of conditional release, not the only issue decided below, namely the formal inadmissibility of the cantonal appeal.

Extrahierte Begründung

The Federal Supreme Court may only review the subject matter defined by the challenged decision; arguments directed at the merits fall outside that scope under Art. 80(1) LTF.

Kernrechtsfrage

Challenge to the cantonal finding that no supplementary motivation had been filed

Extrahierter Entscheid

The appellant did not show arbitrariness in the cantonal findings that he had not supplemented his appeal.

Extrahierte Begründung

He alleged without proof that he had sent a supplementary submission that was returned. This did not sufficiently contest the cantonal factual findings, and such a departure from them was inadmissible under Art. 105(2) LTF.
