The Federal Criminal Court noted that the appellant, through counsel, withdrew the nullity appeal by letter of 28 March 2008. As a result, it struck the case from the docket and ordered that no court costs be charged. The underlying appeal concerned revocation of a suspended sentence under Art. 46 CP.
Withdrawal of an appeal before the Federal Supreme Court; once the appellant expressly withdraws the remedy, the proceedings are terminated and the case is struck off the docket. In the absence of any further dispute, the court may dispense with judicial costs (consid. 1).
