Omnilex-Zusammenfassung

The Federal Supreme Court did not enter into the complaint against the Zurich cantonal decision concerning a fine for telephone misuse. The cantonal court had refused to hear the appeal because the appellant failed to address the decisive procedural question of her unexcused absence from the scheduled main hearing. Before the Federal Supreme Court she argued only the merits, so the complaint was inadmissible. Court costs of CHF 800 were charged to her.

Omnilex-Regeste

Art. 108 BGG; admissibility of a complaint where the appellant fails to contest the decisive ground of the cantonal decision. A federal complaint is inadmissible if it does not engage with the reasoning that is determinative for the challenged decision; submissions addressing only the substantive merits cannot cure this defect. The Federal Supreme Court reviews only the grounds relevant to the non-entry decision below, and merely reiterating the merits is insufficient to establish a legally adequate challenge (consid. 1). Court costs are allocated to the unsuccessful party under Art. 66 Abs. 1 BGG (consid. 2).

Urteil vom 5. März 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführerin,

gegen

Stadtrichteramt Zürich, Gotthardstrasse 62, Postfach, 8022 Zürich,
Beschwerdegegner.

Gegenstand
Gerichtliche Beurteilung, Busse (Missbrauch des Telefons),

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 18. Januar 2008.

Der Präsident zieht in Erwägung:
1.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Kernrechtsfrage

Whether the appeal to the Federal Supreme Court was admissible despite not addressing the decisive issue in the cantonal appeal

Extrahierter Entscheid

The complaint was inadmissible because the appellant argued only the merits of the case and did not deal with the only relevant question: whether she had commented on, or had to comment on, her unexcused absence from the hearing.

Extrahierte Begründung

The Federal Supreme Court was bound by the reasoning of the cantonal decision, which had declined to enter into the appeal for failure to address the decisive point. Since the appellant did not engage with that procedural issue before the Court, her submissions could not be heard.
