Omnilex-Zusammenfassung

A criminal appeal against a Ticino non-prosecution order was filed after the cantonal appeals court had declared the underlying complaint inadmissible for lack of motivation. The Federal Supreme Court held that the appellant did not comply with the motivation requirements of Art. 42 LTF because she failed to engage with the cantonal court's formal inadmissibility ground and instead argued the alleged abusiveness of a seizure. The appeal was decided in simplified procedure and declared inadmissible. Court costs were waived, and the request for suspensive effect became moot.

Omnilex-Regeste

Art. 42 cpv. 1 e 2 LTF; art. 108 cpv. 1 lett. b LTF; a federal appeal is inadmissible where the appellant fails to address the decisive reasoning of the challenged judgment and merely restates grievances unconnected to that reasoning. The duty of motivation requires concise, specific critique of the lower court's grounds; absent such confrontation, the court may dispose of the matter in summary procedure without entering into the merits (consid. 1). Waiver of costs may be ordered under art. 66 cpv. 1 seconda frase LTF. A request for suspensive effect is moot once the appeal is finally dismissed or declared inadmissible.

Sentenza del 13 febbraio 2014

Corte di diritto penale

Composizione
Giudice federale Schneider, Giudice unico,
Cancelliera Ortolano Ribordy.

Partecipanti al procedimento
A.________,
ricorrente,

contro

Considerando:

che con sentenza del 9 gennaio 2014 la Corte dei reclami penali del Tribunale d'appello del Cantone Ticino (CRP) ha dichiarato irricevibile il reclamo interposto da A.________ contro il decreto di non luogo a procedere emanato il 10 dicembre 2013 dal Procuratore pubblico, perché il rimedio giuridico non rispettava le esigenze di motivazione di cui all'art. 385 CPP;
che A.________ ha presentato ricorso al Tribunale penale federale, da questo trasmesso d'ufficio per competenza al Tribunale federale;
che secondo l'art. 42 cpv. 1 e 2 LTF, oltre alle conclusioni e all'indicazione dei mezzi di prova, il ricorso deve contenere i motivi nei quali la parte ricorrente deve spiegare in modo conciso perché l'atto impugnato viola il diritto (DTF 138 I 171 consid. 1.4);
che, oltre a non formulare specifiche domande di giudizio, il gravame in esame disattende completamente le esigenze di motivazione poste dalla LTF;
che infatti la ricorrente si dilunga nell'indicare le ragioni per cui a suo parere sarebbe abusivo il pignoramento dei suoi beni, ma non si confronta minimamente con il motivo formale posto a fondamento della decisione della CRP, segnatamente la carente (e alquanto confusa) motivazione del reclamo;
che il ricorso, manifestamente non motivato in modo sufficiente, sfugge a un esame di merito e può essere deciso sulla base della procedura semplificata dell'art. 108 cpv. 1 lett. b LTF;
che si può rinunciare a prelevare spese giudiziarie (art. 66 cpv. 1 seconda frase LTF );
che l'emanazione di questa sentenza rende priva d'oggetto la domanda di conferimento dell'effetto sospensivo contenuta nel ricorso;

per questi motivi, il Giudice unico pronuncia:

1.

Il ricorso è inammissibile.

2.

Non si prelevano spese giudiziarie.

3.

Comunicazione alle parti e alla Corte dei reclami penali del Tribunale d'appello del Cantone Ticino.

Von Omnilex extrahiert

Kernrechtsfrage

Whether the federal criminal appeal was sufficiently reasoned under the Federal Supreme Court Act.

Extrahierter Entscheid

The appeal did not meet the statutory motivation requirements because it failed to address the cantonal court's formal ground of inadmissibility.

Extrahierte Begründung

Under Art. 42(1)-(2) LTF, the appellant must state concise reasons showing how the challenged decision violates the law. The submissions concerned alleged abuse of seizure measures but did not engage with the CRP's finding that the cantonal complaint was inadequately and confusingly reasoned.

Kernrechtsfrage

Whether the request for suspensive effect had to be decided separately.

Extrahierter Entscheid

The request became moot once the decision on inadmissibility was rendered.

Extrahierte Begründung

The federal judgment itself disposed of the matter, leaving no remaining need to decide the suspensive-effect request.

Kernrechtsfrage

Whether court costs should be charged.

Extrahierter Entscheid

No court costs were levied.

Extrahierte Begründung

The court exercised discretion under Art. 66(1) second sentence LTF and waived costs.
