Omnilex-Zusammenfassung

The Federal Supreme Court held that the complainant lacked standing to challenge the cantonal authority’s refusal to open criminal proceedings concerning alleged offences by a criminal network. He was neither a private prosecutor without the participation of the public prosecutor nor a victim within the meaning of the Victim Support Act, and injured parties otherwise have no right to lodge a criminal complaint under Art. 81(1) BGG. The complaint was therefore not entered into. Court costs of CHF 800 were charged to the complainant.

Omnilex-Regeste

Art. 81 Abs. 1 BGG; standing to appeal against a refusal to open criminal proceedings. An injured person is not entitled to lodge a criminal-law complaint merely by alleging possible offences; absent victim status under the Victim Support Act or a private prosecution context, standing is denied. Where the appellant lacks such standing, the Federal Supreme Court does not enter into the complaint under Art. 108 BGG. Court costs follow the outcome and are imposed on the unsuccessful complainant pursuant to Art. 66 Abs. 1 BGG.

Urteil vom 17. April 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons St. Gallen, Schützengasse 1, 9001 St. Gallen,
Beschwerdegegnerin.

Gegenstand
