Omnilex-Zusammenfassung

X.________ Ltd appealed to the Federal Supreme Court against a Geneva order confirming the dismissal of its complaint for data damage against Y.________ and Z.________. The Court held that the company complained only of patrimonial harm and therefore did not have victim status under the LAVI. It was thus not entitled to challenge the factual findings or the application of criminal law on the merits. The appeal was manifestly inadmissible. As the losing party, the appellant had to pay court costs of CHF 800.

Omnilex-Regeste

Art. 1 and 37 LAVI; Art. 81 al. 1 let. b ch. 5 and 6 LTF; Art. 108 al. 1 let. a LTF; standing of a complainant without victim status to appeal a dismissal of criminal proceedings. A person alleging only injury to patrimonial interests is not a victim within the meaning of the LAVI and therefore lacks standing to challenge the merits of the criminal dismissal before the Federal Supreme Court. Such a complainant may only invoke the denial of the right to file a complaint in offences not prosecuted ex officio or a formal denial of justice equivalent to a denial of justice. Otherwise the appeal is manifestly inadmissible (consid. 1). Costs follow the outcome under Art. 66 al. 1 LTF.

Faits:

A.
X.________ Ltd a porté plainte contre Y.________ et Z.________ pour détérioration de données (art. 144bis CP).

Kernrechtsfrage

Whether the complainant had standing to challenge the dismissal of the criminal complaint before the Federal Supreme Court.

Extrahierter Entscheid

No. Because it alleged only damage to patrimonial interests and no direct injury to physical, psychological, or sexual integrity, it was not a victim under the LAVI and lacked standing on the merits.

Extrahierte Begründung

A non-victim may appeal on the merits only in narrow exceptions. Here the complaint concerned property interests only, so the appellant could not contest the facts or criminal-law application; the appeal was therefore manifestly inadmissible under Art. 108(1)(a) LTF.

Kernrechtsfrage

Allocation of court costs

Extrahierter Entscheid

The appellant had to bear the judicial costs because it failed in the proceeding.

Extrahierte Begründung

Under Art. 66(1) LTF, the unsuccessful party pays the costs.
