Kernrechtsfrage
Whether the first interviews of the child and his brother were usable despite lack of defense participation and late confrontation
Extrahierter Entscheid
The earlier interviews could not be relied on as the decisive basis for conviction because the defendant was not given a timely and effective opportunity to question the witnesses.
Extrahierte Begründung
The right under Art. 6(3)(d) ECHR requires an effective chance to challenge the witness evidence at least once. Although later repeat interviews were held, they occurred years after the events, when the child and brother could only vaguely remember and mainly confirmed their earlier statements. That was not an effective substitute for a timely confrontation.
