Omnilex-Zusammenfassung

The Federal Supreme Court held that the complainant’s filing was abusive and therefore inadmissible. It refused to enter into the complaint under Art. 42(7) and Art. 108 BGG. Because the complaint had no prospect of success, the request for free legal aid was denied. Court costs of CHF 800 were imposed on the complainant. The decision was issued by the President of the Criminal Division.

Omnilex-Regeste

Art. 42 Abs. 7 BGG, Art. 108 BGG; abusive submissions and non-entry: A complaint that is manifestly abusive, in particular because of disrespectful or contemptuous form, is inadmissible and may be disposed of in simplified proceedings under Art. 108 BGG. The Federal Supreme Court is not required to engage substantively with such filings. If the complaint is devoid of any prospect of success, legal aid must be refused under Art. 64 BGG. Court costs are imposed on the unsuccessful complainant pursuant to Art. 66 Abs. 1 BGG (consid. 1-2).

Urteil vom 3. März 2014

Strafrechtliche Abteilung

Besetzung
Bundesrichter Mathys, Präsident,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich,
Beschwerdegegnerin.

Gegenstand
Nichtanhandnahme,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 6. Januar 2014.

Der Präsident zieht in Erwägung:

1.

4.

Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Von Omnilex extrahiert

Kernrechtsfrage

Whether the complaint is admissible despite being abusive and disrespectful in form.

Extrahierter Entscheid

No. The filing is abusive within the meaning of Art. 42(7) BGG and therefore inadmissible; the Federal Supreme Court will not enter into it under Art. 108 BGG.

Extrahierte Begründung

The opening submission contains contemptuous statements and is sent to the court unreadably in substance, which qualifies as abuse of process.

Kernrechtsfrage

Whether the request for legal aid should be granted.

Extrahierter Entscheid

No. Legal aid is refused because the complaint had no prospects of success.

Extrahierte Begründung

Since the complaint was plainly inadmissible, the request for free legal assistance fails for lack of any chance of success.

Kernrechtsfrage

Who bears the court costs.

Extrahierter Entscheid

The complainant must bear the court costs.

Extrahierte Begründung

As the complaint is not entered into and the legal aid request is denied, costs are charged to the complainant under Art. 66(1) BGG.
