Lack of standing in criminal appeal by injured party

Omnilex-Zusammenfassung

The Federal Court, acting through the President in simplified procedure, held that the complainant lacked standing to appeal under Art. 81 LTF because she had not shown a direct injury to protected bodily, sexual, or psychological integrity. Her challenge to the Geneva dismissal decision was therefore inadmissible. The Court also rejected her request for legal aid, finding the appeal manifestly hopeless, and imposed reduced court costs of CHF 500 in light of her financial circumstances.

Omnilex-Regeste

Art. 81 LTF; standing of a mere injured party in criminal matters; a person who is not a victim within the meaning of Art. 2 al. 1 LAVI is in principle not entitled to appeal a criminal dismissal decision. Standing requires that the appellant show a direct infringement of legally protected interests, in particular bodily, sexual or psychological integrity, or otherwise satisfy the statutory requirements for participation and legal interest (consid. 2). Where such showing is absent, the appeal is manifestly inadmissible under Art. 108 al. 1 let. a LTF. Legal aid under Art. 64 al. 1 LTF is excluded when the appeal is devoid of prospects of success; court costs may nevertheless be reduced under Art. 66 al. 1 LTF according to the appellant’s financial situation.

Objet

Faits :
A.
