Omnilex-Zusammenfassung

The appellant challenged the cantonal dismissal of his objection, arguing that he had not been properly summoned because the postal notice was allegedly incorrect. The Federal Supreme Court held that he failed to show that the cantonal court's factual finding was manifestly wrong, since the documents he produced did not relate to the specific shipment. The complaint was therefore not entered upon under Art. 108 BGG. Court costs of CHF 800 were imposed on the appellant.

Omnilex-Regeste

Art. 97 Abs. 1 BGG; Art. 108 BGG; admissibility of a complaint against factual findings: the party must demonstrate, with reference to the contested concrete evidence, that the lower court's finding is manifestly incorrect. Submissions that do not concern the specific evidentiary item at issue cannot establish obvious error. If the decisive factual challenge fails, the Federal Supreme Court need not examine alternative or subsidiary reasoning of the lower court and may decline to enter on the complaint. Under Art. 66 Abs. 1 BGG, the costs of the inadmissible proceeding are borne by the complaining party.

Urteil vom 28. August 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Basel-Stadt, Binningerstrasse 21, Postfach, 4001 Basel,
Beschwerdegegnerin.

Gegenstand
Verfahrensmangel,

Beschwerde gegen das Urteil des Appellations-
gerichts des Kantons Basel-Stadt, Ausschuss, vom 25. Februar 2008.

Der Präsident zieht in Erwägung:

1.

Kernrechtsfrage

Whether the complaint showed that the cantonal court's factual findings were manifestly incorrect under Art. 97(1) BGG.

Extrahierter Entscheid

The appellant did not establish that the factual finding was manifestly incorrect; the supporting documents did not concern the specific postal item.

Extrahierte Begründung

The challenged submissions were unrelated to the concrete shipment, so the factual finding could not be shown to be obviously wrong.

Kernrechtsfrage

Whether the complaint could be examined despite the deficient factual challenge.

Extrahierter Entscheid

No. Because the required showing was not made, the court did not need to address the subsidiary reasoning of the cantonal court and could not enter on the complaint under Art. 108 BGG.

Extrahierte Begründung

Without a substantiated challenge to the decisive facts, the complaint failed at the admissibility stage.

Kernrechtsfrage

Court costs

Extrahierter Entscheid

Costs were imposed on the appellant.

Extrahierte Begründung

As the complaint was not entered upon, the appellant had to bear the court costs under Art. 66(1) BGG.
