Omnilex-Zusammenfassung

The defendant challenged a cantonal criminal appeal judgment before the Federal Supreme Court and also requested legal aid. The Court held that the filing failed to meet the statutory reasoning requirements: the complaints about lack of evidence, appointed counsel, and alleged misconduct by others were merely asserted and not substantiated. The appeal was therefore declared inadmissible. Because the appeal had no prospect of success, legal aid was refused and reduced court costs of CHF 500 were imposed on the appellant.

Omnilex-Regeste

Art. 42 al. 1 and 2 LTF, Art. 106 al. 2 LTF; admissibility of a federal criminal appeal and requirements of substantiated reasoning. A federal appeal must state the conclusions, grounds and evidence and must explain succinctly how the challenged decision violates the law. Allegations concerning fundamental rights, in particular arbitrariness, are subject to a strict pleading burden; merely appellatory criticism is insufficient. If the submission fails to satisfy these requirements, the Court does not enter into the appeal under Art. 108 al. 1 let. b LTF. Legal aid under Art. 64 LTF is refused where the appeal manifestly lacks chances of success; costs are then borne by the unsuccessful appellant under Art. 66 al. 1 LTF, taking financial circumstances into account.

Objet

Whether the criminal appeal met the Federal Supreme Court's admissibility and reasoning requirements

Extrahierter Entscheid

No. The appeal did not set out substantiated legal arguments and was therefore inadmissible.

Extrahierte Begründung

The appellant merely asserted complaints, such as lack of proof and bias, without specifying how the challenged decision violated federal law or supporting his allegations as required by Arts. 42 and 106 LTF. Appellatory criticism is insufficient.

Kernrechtsfrage

Whether the appellant was entitled to legal aid

Extrahierter Entscheid

No. Because the appeal had no prospect of success, legal aid had to be refused.

Extrahierte Begründung

An appeal manifestly lacking chances of success does not justify legal aid under Art. 64 LTF.

Kernrechtsfrage

Who must bear the court costs

Extrahierter Entscheid

The appellant must bear the reduced court costs, fixed at CHF 500.

Extrahierte Begründung

Costs follow the unsuccessful, inadmissible appeal and were reduced in light of the appellant's financial situation.
