Omnilex-Zusammenfassung

The Federal Supreme Court declared the criminal appeal inadmissible. The appellant challenged a cantonal decision confirming the refusal to open criminal proceedings for alleged fraud in trial, forgery, and suppression of documents. The Court held that he had not demonstrated victim status under the Victim Support Act and had not shown any direct injury of the kind required for standing in criminal matters. As a result, the Court did not examine the merits and ordered the appellant to pay CHF 800 in judicial costs.

Omnilex-Regeste

Art. 81 LTF in conjunction with Art. 2 al. 1 LAVI; standing to appeal in criminal matters of a non-victim injured party. A person who is not a victim within the meaning of the LAVI lacks standing to lodge a criminal law appeal unless he shows a direct injury to his bodily, sexual or psychological integrity caused by the offence complained of. Mere procedural interest or denunciation of offences is insufficient. Where standing is absent, the Federal Supreme Court does not enter into the merits and the appeal is inadmissible (consid. 1-2). Costs follow the outcome under Art. 66 al. 1 LTF.

Objet
Refus d'ouvrir une action publique (escroquerie, etc.),

Faits:

A.
