Omnilex-Zusammenfassung

The Federal Supreme Court held that the state constitutional complaint against the Zurich Criminal Chamber judgment was filed too late. Since the challenged decision was issued before the entry into force of the Federal Supreme Court Act, the former procedural rules applied, including the 30-day filing period under the OG. The later decision of the cantonal cassation court did not revive or extend the deadline. The court therefore declined to enter into the complaint and charged the complainant with the federal court fee of CHF 1,000.

Omnilex-Regeste

Art. 89 Abs. 1 OG; timeliness of a state constitutional complaint under the former procedural law. Where the challenged cantonal decision predates 1 January 2007, the appeal remains governed by the OG pursuant to Art. 132 Abs. 1 BGG e contrario. The complaint must be filed within 30 days from the legally relevant service of the impugned decision; expiry of that period is not cured by a subsequent cantonal cassation decision unless the latter itself is the object of challenge. An untimely complaint is not entered into. Costs follow the outcome under Art. 156 Abs. 1 OG.

Urteil vom 7. Juni 2007

Besetzung
Bundesrichter Schneider, Präsident,
Bundesrichter Ferrari, Favre,
Gerichtsschreiber Monn.

Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Postfach, 8090 Zürich,
Obergericht des Kantons Zürich, I. Strafkammer, Postfach, 8023 Zürich.

Gegenstand
Strafverfahren; Willkür, rechtliches Gehör, Verletzung des Beschleunigungsgebots,

Staatsrechtliche Beschwerde gegen das Urteil des Obergerichts des Kantons Zürich, I. Strafkammer, vom 5. Oktober 2005.

Das Bundesgericht zieht in Erwägung:
1.

Kernrechtsfrage

Whether the state constitutional complaint against the Obergericht judgment was timely filed

Extrahierter Entscheid

The complaint was out of time under the former procedural law and therefore could not be examined on the merits.

Extrahierte Begründung

Because the challenged decision predated 1 January 2007, the old procedural law applied; under Art. 89(1) OG the complaint had to be filed within 30 days from service. That period had long expired, and a later decision of the Kassationsgericht did not affect the timeliness of the complaint against the Obergericht judgment.

Kernrechtsfrage

Allocation of federal costs

Extrahierter Entscheid

The complainant had to bear the federal court costs.

Extrahierte Begründung

The dismissal for inadmissibility meant the losing party bore the costs under Art. 156(1) OG.
