Kernrechtsfrage
Whether the office could refuse to seize the debtor's claim because it was allegedly transferred or waived before the continuation request.
Extrahierter Entscheid
The office had to seize the claim; alleged transfer, waiver, or third-party entitlement did not justify refusing seizure because the claim was neither manifestly nonexistent nor manifestly not the debtor's.
Extrahierte Begründung
In enforcement, a claimed third-party right over a patrimonial asset does not prevent seizure; it only affects the order of seizure. Only when prior assets suffice, or the claim is manifestly nonexistent or clearly not the debtor's, may the office omit seizure. Otherwise the office must seize and leave title disputes to the revendication procedure under Arts. 106 ff. LP.
