Kernrechtsfrage
When does suspension of an invalidity pension under Art. 21(5) ATSG begin if the convicted person starts serving the sentence late?
Extrahierter Entscheid
Suspension begins only once the insured person has actually submitted to the ordered deprivation of liberty; the pension must be paid until the end of the month before actual imprisonment, and suspension applies from the next month.
Extrahierte Begründung
Art. 21(5) ATSG ties suspension to being in penal or measure custody in a legal and factual sense. A late, unlawful failure to present for sentence is not equivalent to being in custody, and the insurer may not benefit from the delay. The text and purpose of the provision indicate that the decisive point is actual commencement of deprivation of liberty.
