SWICA challenged a Ticino insurance court remand judgment before the Federal Supreme Court. The appeal was mailed on 15 June 2013, but the 30-day deadline expired on 14 June 2013. Sitting under the simplified procedure, the court declared the appeal inadmissible. It expressly left open whether the cantonal remand decision could have caused irreparable harm under Art. 93(1)(a) BGG. No court costs were imposed.

Where inadmissibility follows from lateness, the question whether an incidental remand decision is capable of causing irreparable prejudice within the meaning of Art. 93 Abs. 1 lit. a BGG may remain open (consid. 1). In the absence of entry into the merits, court costs may exceptionally be waived pursuant to Art. 66 Abs. 1 second sentence BGG.
