Kernrechtsfrage
Must the insurer issue a formal decision on whether the 11 November 2003 pension decision has become final?
Extrahierter Entscheid
No. Finality of a benefits decision is not itself a matter requiring a formal decision under Art. 49 ATSG; the insured must use ordinary remedies against the original decision if it was not validly finalized.
Extrahierte Begründung
A declaratory decision is only warranted where there is a current protectable interest. Such an interest was lacking because, if the pension decision was not formally final, an objection against that decision was available and the insurer could address finality within that procedure.
