Housing allowance granted for inadequate room size

ATA/182/1998Cour de justice / Verwaltungskammer31.03.1998Partially Granted

Omnilex-Zusammenfassung

The appellant challenged the refusal of a housing allowance. She argued that her ex-husband’s conduct toward her and the fact that her 24-year-old daughter had to live in a 7.69 m2 room justified the allowance. The court held that the alleged conduct was not proved and therefore did not constitute a major inconvenience under Art. 39A LGL. It nevertheless found that requiring an adult daughter to live in such a small room was incompatible with decent housing. The appellant was therefore entitled to a housing allowance in her new, larger dwelling.

Omnilex-Regeste

Art. 39A LGL; housing allowance and the notion of major inconvenience; Art. 10A Cst. gen.; the right to decent housing is not directly enforceable as a claim to obtain housing, but it may support entitlement to housing-related benefits where the previous accommodation is objectively inadequate. Alleged harassment by a former spouse does not establish a major inconvenience absent proof. A 7.69 m2 room for a 24-year-old adult is incompatible with decent housing conditions, justifying allowance relief (consid. not stated).

Kernrechtsfrage

Whether the alleged conduct of the appellant's ex-husband constituted a major inconvenience under Art. 39A LGL.

Extrahierter Entscheid

The alleged conduct was not proved and therefore did not amount to a major inconvenience within the meaning of Art. 39A LGL.

Extrahierte Begründung

The record did not establish the alleged acts, including following her to her home, with sufficient proof.

Kernrechtsfrage

Whether the appellant was entitled to a housing allowance after moving to a larger apartment because her daughter previously lived in a 7.69 m2 room.

Extrahierter Entscheid

Yes. A 24-year-old person cannot reasonably be required to live in such a small room, and the appellant therefore qualified for a housing allowance in the new, larger dwelling.

Extrahierte Begründung

The court relied on the constitutional right to decent housing under Art. 10A Cst. gen.; although this provision does not create a justiciable right to obtain housing, it supports the entitlement to decent housing conditions.
