Omnilex-Zusammenfassung

The insured suffered a dental injury while eating self-prepared birchermuesli containing a hazelnut shell fragment. The court held that the presence of the shell fragment was not reasonably foreseeable and that the record did not show a tooth weakness capable of breaking under normal pressure. The event therefore had the necessary accident character under Art. 9(1) OLAA.

Omnilex-Regeste

Art. 9 al. 1 OLAA; accident character of a dental injury caused by a foreign object in food. An external event is extraordinary where the injured person, having prepared the meal himself, could not reasonably expect the presence of a shell fragment in the food. Accident character is not excluded absent proof that the affected tooth was so weakened that it would have broken under ordinary chewing pressure. The decisive factors are foreseeability of the foreign object and the absence of an alternative explanation based on pre-existing fragility (consid. as summarized).

Kernrechtsfrage

Whether the dental injury caused by a hazelnut shell fragment in birchermuesli qualifies as an accident under Art. 9(1) OLAA.

Extrahierter Entscheid

Yes. The insured could not reasonably expect a leftover shell fragment in a meal he had prepared himself, and the file did not show that the tooth was so weak that it would have failed under normal pressure.

Extrahierte Begründung

An extraordinary external cause was admitted because the shell fragment was not foreseeable in the meal as prepared, and no pre-existing dental fragility excluded accident character.
